EU Court Upholds Rejection of Appeal from Telecommunications Giants

BRUSSELS The Court of Justice of the European Union upheld on Wednesday a ruling that rejected an appeal filed by Spanish and Portuguese telecommunications companies over fines they were imposed in 2010.

Telefonica and PT had been fined 66.9 million euros and 12.3 million euros, respectively, by the European Commission for a non-compete clause included in the purchase of Brazilian telecoms group Telefonica Vivo in which they each pledged to not invest in projects that could create competition for the other.

Telefonica had appealed the ruling, citing a violation of its right to defense, an error of law and errors in the assessment of its behavior and extenuating circumstances.

The EUs General Court had rejected the appeal in 2016, a ruling that has now been upheld by the CJEU.
